เผยแพร่วันที่ 22 ตุลาคม 2557 ใบแจ้งข่าว สองผู้ต้องหาพม่าคดีเกาะเต่า ยื่นหนังสือผ่านตัวแทนสภาทนายความ ร้องขอความเป็นธรรมต่อพนักงานอัยการจังหวัดเกาะสมุย ปฏิเสธไม่ได้ฆ่าหรือข่มขืนนักท่องเที่ยวชาวอังกฤษ ระบุถูกเจ้าหน้าที่ซ้อมให้รับสารภาพ เมื่อวันที่ 20 ตุลาคม พ.ศ. 2557 คณะกรรมการสิทธิมนุษยชน สภาทนายความ ได้แต่งตั้งคณะทำงานเพื่อให้ความช่วยเหลือคดีที่ผู้ต้องหาชาวพม่าสองราย นาย วิน หรือเนวิน และนายซอ ถูกตั้งข้อหาในคดีอาญา จากเหตุการณ์ฆาตกรรมสองนักท่องเที่ยวชาวอังกฤษ นายเดวิด มิลเลอร์ วัย 24 ปี และนางสาวฮันนาห์ วิทเธอริดจ์ วัย 23 ปี ที่เกาะเต่า จังหวัดสุราษฎร์ธานี เหตุเกิดเมื่อวันที่ 15 กันยายน พ.ศ.2557 โดยมีนายสุรพงษ์ กองจันทึก เป็นหัวหน้าคณะทำงานช่วยเหลือคดีและประเด็นอื่นๆที่อาจจะเกี่ยวข้องกับการละเมิดสิทธิมนุษยชนของผู้ต้องหาในคดีอาญา โดยมีทนายความอาวุโสจำนวนหนึ่งร่วมเป็นคณะทำงานดังกล่าวด้วย ความคืบหน้าล่าสุด วันที่ 21 ตุลาคม พ.ศ. 2557 ทนายความของคณะทำงานดังกล่าวได้เข้าพบผู้ต้องหาเพื่อสอบข้อเท็จจริง โดยทางเรือนจำอำเภอเกาะสมุยได้จัดพื้นที่ให้คณะทนายความได้พูดคุยกับผู้ต้องหาได้อย่างเป็นอิสระ การสอบข้อเท็จจริงใช้ระยะเวลากว่า 5 ชั่วโมง […]

แถลงการณ์ ขอ ให้ยุติการกระทำที่ละเมิดสิทธิของครอบครัวผู้ เสียหายและผู้ต้องหา กรณี การปฏิบัติหน้าที่ของเจ้าหน้าที่และสื่อมวลชนใน คดีเกาะเต่า จาก กรณีเมื่อวันที่ 15 กันยายน 2557 เกิด เหตุสองนักท่องเที่ยวชาวอังกฤษถูกทำร้ายและเสีย ชีวิตอยู่ริมชายหาดเกาะเต่า จังหวัดสุราษฎร์ธานี ต่อมาในวันที่ 2 ตุลาคม 2557 เจ้า หน้าที่ตำรวจได้ควบคุมตัวผู้ต้องสงสัยเป็นแรงงาน ชาวพม่าจำนวน 3 ราย โดยจากการสอบสวนเพิ่มเติมของพนักงานสอบสวนทำผู้ ต้องหาให้การรับสารภาพว่ากระทำความผิดตามข้อกล่าว หา และในวันที่ 3 ตุลาคม 2557 เจ้า พนักงานสอบสวนได้นำตัวผู้ต้องหา 2 รายไปแถลงข่าวและทำแผนประกอบคำรับสารภาพในที่เกิดเหตุ ปรากฏตามรายงานข่าวของสื่อมวลชนไปแล้วนั้น เนื่องจากคดีดังกล่าวอยู่ระหว่างชั้นสอบสวน ผู้ต้องหาต้องได้รับการสันนิษฐานไว้ก่อนว่าเป็นผู้ บริสุทธิ์จนกว่าจะมีคำพิพากษาถึงที่สุด ดังนั้นการปฏิบัติต่อผู้ต้องหาจะกระทำเหมือนผู้ กระทำความผิดแล้วไม่ได้ สมาคมนักกฎหมายสิทธิมนุษยชนและองค์กรข้างท้ายมีความห่วงใยว่าการปฏิบัติ หน้าที่ของเจ้าหน้าที่รัฐที่เกี่ยวข้องและ สื่อมวลชนอาจเป็นการละเมิดสิทธิในความเป็นส่วนตัว ของครอบครัวผู้เสียหายและละเมิดสิทธิของผู้ต้องหา ตามหลักการดังต่อไปนี้ 1. การ ให้การในคดีที่มีโทษประหารชีวิต หากผู้ต้องหาไม่มีทนายความ พนักงานสอบสวนมีหน้าที่ตามกฎหมายในการจัดหาทนายความให้ผู้ต้องหาตามมาตรา 134/1 ประมวล กฎหมายวิธีพิจารณาความอาญาและกติกา […]

นับตั้งแต่พ.ศ.2553สำนักงานประกันสังคมได้สัญญาว่าจะให้การคุ้มครองลูกจ้างแรงงานข้ามชาติที่ผ่านการพิสูจน์สัญชาติ เข้ามาทำงานถูกกฎหมายและได้ขึ้นทะเบียนประกันตน จ่ายเงินสมทบว่าจะได้รับสิทธิประโยชน์ 7 กรณีเท่ากับแรงงานไทย ข้อสัญญาดังกล่าวถูกทำให้เป็นนโยบายโดยผ่านมติคณะรัฐมนตรี เมื่อวันที่ 15 มกราคม พ .ศ . 2556โดยกำหนดให้สำนักงานประกันสังคมดำเนินการให้แรงงานข้ามชาติที่ได้รับอนุญาตทำงานตามมาตรา 9 แห่งพระราชบัญญัติการทำงานของคนต่างด้าว พ.ศ. 2551 เข้าสู่ระบบประกันสังคมตามที่กฎหมายกำหนด แรงงานข้ามชาติได้บากบั่นทำตามข้อกำหนดทุกขั้นตอนพวกเขาจ่ายเงินค่าธรรมเนียมเพื่อทำให้ตัวเองถูกกฎหมายและเชื่อว่าจะได้รับสิทธิที่แท้จริงสมกับความพยายามหลังจากที่พวกเขาเข้าสู่กระบวนการแล้ว ซึ่งรวมถึงเป็นประตูไปสู่การได้รับค่าจ้างขั้นต่ำ300บาทต่อวันการได้รับการคุ้มครองภายใต้ระบบประกันสังคมที่ได้สิทธิประโยชน์ 7 กรณีและหากประสบอันตรายหรือเจ็บป่วยเนื่องจากการทำงานให้นายจ้าง ลูกจ้างสามารถรับสิทธิกองทุนเงินทดแทนได้ แต่ว่ากลายเป็นว่าพวกเขากำลังถูกหลอก มิใช่แค่ว่าพวกเขาส่วนใหญ่ไม่ได้ค่าจ้าง300บาทจริงๆแล้วแต่ขณะนี้ดูเหมือนว่าสิทธิประโยชน์ประกันสังคมที่พวกเขาจะได้รับทั้งเจ็ดประการกำลังถูกทำให้ลดลงไปต่อหน้าต่อตา เมื่อวันที่28พฤษภาคมพ.ศ.2556นพ.สมเกียรติฉายะศรีวงศ์ปลัดกระทรวงแรงงานได้เปิดเผยว่าตนได้ศึกษาข้อกฎหมายและมาตรฐานขององค์การแรงงานระหว่างประเทศ(ไอแอลโอ)ทำให้โดยส่วนตัวเห็นว่าไม่ควรให้แรงงานต่างด้าวได้รับสิทธิประโยชน์ประกันสังคมเท่าเทียมกับแรงงานไทยทั้งหมดควรออกเป็นกฎหมายเฉพาะโดยจากคำให้สัมภาษณ์ดูเหมือนว่าแรงงานหญิงจะตกเป็นเป้าในการจำกัดสิทธิที่ชัดเจนในขณะที่กรณีคลอดบุตรยังคงได้รับการคุ้มครองเฉพาะการทำคลอด แต่แรงงานหญิงจะถูกยกเว้นเงินทดแทนการขาดรายได้ในช่วงที่ลาคลอด และกรณีสงเคราะห์บุตร เพื่อส่งเสริมให้แรงงานต่างด้าวเห็นความสำคัญของการคุมกำเนิด เพื่อไม่ให้แรงงานต่างด้าวเข้ามาตั้งถิ่นฐานในไทยเพราะแรงงานเหล่านี้เข้ามาเพื่อทำงานในไทยระยะเวลาหนึ่งเท่านั้นและกรณีชราภาพควรปรับเปลี่ยนวิธีการจ่ายเงินในรูปแบบบำเหน็จแทนการจ่ายเงินแบบบำนาญปลัดกระทรวงแรงงานยังกล่าวด้วยว่าส่วนกรณีว่างงานนั้นแรงงานต่างด้าวไม่ควรได้รับความคุ้มครองเนื่องจากเข้ามาทำงานในไทยด้วยความสมัครใจเมื่อพ้นสภาพการทำงานจึงต้องปฏิบัติตามกฎหมายคนเข้าเมือง โดยต้องเดินทางออกจากประเทศไทยภายใน 7 วัน 1 มูลนิธิเพื่อสุขภาพและการเรียนรู้ของแรงงานกลุ่มชาติพันธุ์ (MAP Foundation) ซึ่งทำงานเพื่อส่งเสริมสิทธิแรงงานข้ามชาติรู้สึกตกใจและผิดหวังที่แนวคิดทางนโยบายเสนอให้มีระบบประกันสังคมสองระดับที่แตกต่างของแรงงานไทยและแรงงานข้ามชาติซึ่งจะมีผลให้แรงงานข้ามชาติกลายเป็นพลเมืองชั้นสองอย่างเป็นระบบ นอกจากนั้นจากการรายงานข่าวของ สำนักข่าวแห่งชาติกรมประชาสัมพันธ์ เมื่อวันที่ 29 กรกฎาคม พ.ศ. 2556 2 ระบุด้วยว่าสำนักงานประกันสังคมได้แก้ไข พระราชบัญญัติประกันสังคม พ.ศ.2533 โดยกำหนดให้แรงงานต่างด้าว ซึ่งเป็นผู้ประกันตนจะไม่ได้รับสิทธิครบ 7 กรณี โดยตัดสิทธิกรณีว่างงาน คลอดบุตรและสงเคราะห์บุตรออกไป […]
