The Asian Human Rights Commission (AHRC) has received information regarding the torture of Mr. Asep Sunandar conducted by police officers of Cianjur police resort (Polres Cianjur), resulting in his death. Asep and two of his friends were arrested without any arrest warrant, and were not granted access to a lawyer during their interrogation. The police tortured Asep to obtain a confession, and then tried to close the case by providing money to the family to avoid prosecution.
CASE NARRATIVE:
On 10 September 2016, at around 4:30 a.m., Mr. Asep Sunandar was arrested along with his two friends by three police officers of the Cianjur police resort. They were brought to the local community head’s house (ketua RW). According to Asep’s two friends, they had guns pointed at them and their hands and mouth were taped. The police did not show any arrest warrant and did not provide any explanation for the arrest.
Asep and his friends did not resist or fight back against the police; they obeyed police instructions. After being arrested, Asep and his two friends were separated; Asep’s friends were brought to Cianjur police resort, whereas Asep was brought to an unknown place.
In the afternoon, Asep’s family was informed by the local hospital (RSUD Cianjur) that Asep had passed away. When his family went to the hospital to see Asep’s dead body, the hospital asked them to obtain a permit from the police. After obtaining the permit, Asep’s family saw his dead body with 12 holes and bleeding. The police denied the family’s request to take his dead body home.
The family’s request for an autopsy was also denied by the hospital. Instead, the Cianjur police resort requested Asep’s family to sign a letter and accept IDR. 5, 000, 000 as compensation for the death of Asep Sunandar.
ADDITIONAL INFORMATION:
Police officers continue to be the most frequent perpetrators of torture in Indonesia. Many cases of torture occur in police custody, particularly during police examination, in order to obtain confessions from suspects. The AHRC in the past two months documented and reported several such cases, including the torture to death of Marianus Oki (AHRC-UAC-076-2016), and the torture to death of Juprianto (AHRC-UAC-080-2016).
SUGGESTED ACTION:
Please write to the authorities listed below, asking them to ensure that a comprehensive investigation is undertaken to prosecute the police officers involved in the torture and death of Mr. Asep Sunandar. The government must ensure that the family of the victim receives appropriate compensation in a timely manner. The investigation must be conducted under the fair trial standard and due process of law.
The AHRC will write a separate letter to the UN Special Rapporteur on Extra-judicial, Summary, or Arbitrary Executions and the Special Rapporteur on Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment calling for their intervention into this matter.
