The Asian Human Rights Commission (AHRC) has received information regarding the brutal shooting of two indigenous Papuan high school students in Petra, Timika, Papua province, Indonesia. Kalep Zera Bagau (18) was shot to death, while Efrando I.S. Sabarofek (17) was seriously injured and is presently hospitalized in Timika.
CASE NARRATIVE:
On 28 September 2015, at around 7 p.m., Indonesian police officers shot two indigenous Papuans, one of whom died instantly. On that evening, the two victims Kaleb and Efrando, along with their friends, were sitting under a tower, when suddenly several police vehicles entered the Biak housing complex and surrounded it.
According to the police, they were searching for youth groups who create public disorder in a place called gorong-gorong. When the police officers did not get enough information from local residents, they parked their vehicle in front of a house belonging to a local resident. Suddenly, a local resident came to the police and reported that some youth created public disorder frequently, and another resident also told the police that the parents of those youth group were affiliated with the Papuan Free Movement (OPM), a rebel group fighting for Papuan independence.
After receiving this report, within ten minutes four police vehicles and 15 police motorcycles entered the Biak complex and surrounded it. Seeing many police officers surrounding the complex, Kaleb ran towards a highway near the State Own Electricity firm (PLN), where he met police officers who shot him in the chest and foot to death. The police officers also shot Efrando who was seriously injured. After shooting the two indigenous Papuans, the police brought them to the local hospital (RSUD) in Timika.
After this brutal shooting, friends and family of the two victims protested and surrounded the police officers at around midnight. This angered the police, resulting in the shooting and injury of the protesters, namely Habel Jagani, who was shot in the knee, Koni Bagau, shot in the hand and the waist, near the right rear thigh, and Debina Selegani, shot in the hand.
ADDITIONAL INFORMATION:
Police brutality in Papua and West Papua provinces of Indonesia occur frequently in various forms and patterns. The AHRC has previously documented and reported the police shooting of 10 Papuan youth, killing one and injuring others (AHRC-UAC-090-2015) and attack killing five teenagers and injuring 17 others by the police and military in Papua (AHRC-UAC-089-2015).
Current president Joko Widodo promised in his presidential campaign to treat indigenous Papuans equally with other Indonesians outside Papua island. However, after almost a year of being in power, various abuses and human rights violations continue in the province, conducted by security forces.
SUGGESTED ACTION:
Please write to the authorities listed below, asking them to ensure that the Indonesian government, in particular President Joko Widodo, fulfill his promise to treat indigenous Papuans better, and ensuring that human rights of indigenous people are protected. The Indonesian chief of police and the Papuan regional chief of police should ensure that independent and prompt investigations are conducted into this case. The National Police Commission (Kompolnas), Ombudsman, National Commission on Human Rights (Komnas HAM) as well as Commission III of the House of Representative on human rights and security should monitor and evaluate every investigation conducted upon this case. The government should provide adequate remedy for the victims and their families without undue delay.
The AHRC is writing a separate letter to the UN Special Rapporteur on Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the UN Special Rapporteur on Extra-judicial, Summary, or Arbitrary Executions, and the UN Special Rapporteur on the rights of the indigenous peoples, calling for their intervention into this matter.
