The Asian Human Rights Commission (AHRC) is deeply concerned that Mr. Hak Sok (51), a candidate of the Norodom Ranariddh party running for the communal election scheduled for April 1, was killed by unidentified men in front of his house on 26 March 2007. He was living in Sangkat number 4, Khan Mitapheap, Sihanoukville, Cambodia. During the incident, his 19-year-old daughter was also seriously injured. The alleged reason behind his killing is due to his election campaigns in his locality.  

CASE DETAILS:

Mr. Hak Sok, a 51-year-old member of the Norodom Ranariddh party, the opposition royal party of Cambodia, was running as a candidate for his party in an upcoming communal election on 1 April 2007.

At around 9:45pm on 26 March 2007, three unidentified men came to Mr. Hak Sok’s house and looked for him. When he came down to see who was calling on him, Mr. Hak Sok was hacked with a machete many times on his face, the back of his head and his shoulder. He died immediately. According to the local sources, the attack was so brutal that his head was severely hacked.

Mr. Hak Sok’s 19-year-old daughter namely Hak Nganh rushed to the scene to help her father, but she was also smashed to the ground and her right hand was nearly cut off by the same unidentified men. When she screamed loudly for help, the killers ran away. Neighbors immediately took Nganh to the Sihanoukville hospital for medical care.

Mr. Hak Sok’s party and local people believe that Mr. Hak Sok’s death is related to his active involvement into the election campaign in Sihanoukville on 23-25 March 2007 for the upcoming communal election. Mr. Hak Sok was the Norodom Ranariddh party’s candidate for the said election scheduled for 1 April 2007.

The victim’s family reported the incident to the Sihanoukville municipality police. When contacted by the AHRC staff on March 28, Sihanoukville police officer Mr. Yin Bunath said that the police had already identified a perpetrator named Pen Chan Thim, who was a co-worker of the victim and are trying to arrest him. The police arrested two other alleged perpetrators, who are also co-workers of the victim, on March 28. The officer claimed that the victim’s killing was not a politically motivated one but the result of an individual conflict. He added that the victim had a heated argument with Pen Chan Thim 4 days before the incident.

However, the AHRC is concerned that the Sihanoukville municipality police made such a rush conclusion within 2 days since the incident, without fully conducting the investigation. Further, it seems that the police made such arrest without any concrete evidence against the three identified suspects. The police did not investigate at all whether the victim had received any threats and intimidation due to his election campaign prior to his killing. This raises concerns about the transparency of the investigation process.

In fact, it is well known that there is blunt violence against members or candidates of the opposition parties members during the election campaign period. The AHRC suspects that Mr. Hak Sok may be yet another victim of such violence.

It is reported that after the creation of the Norodom Ranariddh party on 16 November 2006, the party members and activists has been allegedly facing killings, beating and death threats as well as the destruction of the party campaign materials.

In this communal election campaign, the Sam Rainsy party (SRP) has also reportedly received many cases from its members across the country regarding intimidation and death threats, destruction of the party billboards and party leaflets, etc.

These are serious acts of political discrimination and brutality and the Cambodian government, as a democratic government with a policy of pluralism, should be responsible for all these acts. These acts are against the constitutional spirit that guarantees the freedom to join a political party or to be a candidate for an election. The Cambodian Constitution clearly guarantees the right to freedom of expression and assembly and political involvement.

The AHRC strongly condemns this inhuman killing and brutality and the blatant affront to the right to freedom of joining a political party and freedom of expression. We strongly urge the Sihanoukville governor and the Cambodian government and authorities to immediately take action to bring the alleged perpetrators before the court. We also urge the Cambodian government to ensure the transparency and impartiality of the investigation into this case. We also urge the government and authorities to guarantee the freedom of joining a political party or freedom to hold election campaigns, according to the democratic standard.

SUGGESTED ACTION:  
Please send a letter to the relevant authorities mentioned below urging them to immediately take action to bring the three perpetrators before the court. Please also urge the Cambodian government to respect the spirit of the Constitution, which has guaranteed the rights and freedoms of the people.

I am writing to express my deep concern that Mr. Hak Sok (51), a candidate of Norodom Ranariddh party running for the communal election scheduled for April 1, was killed by the three unidentified men in front of his house on 26 March 2007. His 19-year-old daughter named Hak Nganh was also seriously injured.

According to the information I have received, when the victim was called down from his house at about 9:45pm on March 26, he was hacked with a machete many time on his face, the back of his head and his shoulder by three unidentified men. He immediately died in what was a brutal cold blooded assault. The victim’s daughter, who tried to rescue her father, was also smashed to the ground and her right hand was nearly cut off by the same unidentified men. When she screamed loudly for help, the killers ran away. Neighbors immediately took Nganh to the Sihanoukville hospital for medical care.

It has come to my knowledge that, Mr. Hak Sok’s death occurred as an aftermath of the election campaign he conducted in his region Sihanoukville on 23-25 March 2007 for the commune election. Mr. Hak Sok was also the Norodom Ranariddh party’s candidate for the upcoming commune election that will be held on 1 April 2007.

I am informed that the Sihanoukville municipality police arrested two suspects on March 28 and look for another suspect and now claim that the victim’s killing is not a politically motivated one but happened due to an individual conflict between the victim and the alleged suspects.

However, I am deeply concerned that the Sihanoukville municipality police made such a hush conclusion within 2 days since the incident, without conducting the thorough investigation. Further, it seems that the police made such arrest without any concrete evidence against the three identified suspects. The police did not investigate at all whether the victim had received any threats and intimidation due to his election campaign prior to his killing. This make me worry about the transparency of the investigation process.

I am well aware about the blunt violence against members or candidates of the opposition parties members during the election campaign period in Cambodia. I suspect that Mr. Hak Sok may be yet another victim of such violence. I am already informed that activists and candidates of the Norodom Ranariddh party and Sam Rainsy party have been reportedly facing beatings, intimidation including death threats before the upcoming communal election.

I strongly condemn this inhuman killing and brutality and the blatant affront to the right to freedom of joining a political party and freedom of expression. The investigation should not be hurried up but conducted in an impartial and transparent way. I also request the Sihanoukville governor and the Cambodian government and authorities to immediately take action to thoroughly investigate this incident and bring those responsible to justice. If the police do not have any concrete evidence against the two arrested suspect, they should be released within 48 hours since their arrest. I am concerned that they might be subjected to torture by the police to extract the forced confession.

I also urge the government and authorities to guarantee the freedom of joining a political party or freedom to hold election campaigns, according to the democratic standard.
